WhatsApp integration
Terms of Service

These terms govern use of the WhatsApp Business API integration provided by Haiku Studio inside the DermaAI clinical EMR (the "WhatsApp integration"). By enabling the WhatsApp integration in your DermaAI workspace, your clinic (the "Clinic") agrees to these terms.
1. The service
The WhatsApp integration lets your Clinic communicate with patients through your own WhatsApp Business number in coexistence mode (your existing WhatsApp app on your phone and the DermaAI integration both work on the same number). It allows you to:
- Send appointment reminders
- Send prescription PDFs and clinical follow-up messages
- Receive patient messages in the DermaAI inbox
- Send marketing or promotional broadcasts to patients who have opted in
2. Your responsibilities
The Clinic is responsible for:
- Patient consent. You must collect specific, informed, recorded consent from each patient before sending any WhatsApp message — including reminders, prescription deliveries, and promotional messages.
- Opt-outs. You must honour opt-out requests immediately. A patient who replies STOP, opts out via WhatsApp, or asks you directly must not receive further messages.
- Template usage. You may only send the content described in your approved message templates. Misusing a template (e.g. marketing content in a transactional template) may cause Meta to suspend your WhatsApp number.
- Compliance. You will comply with applicable laws including the Digital Personal Data Protection Act 2023, the Telecom Commercial Communications Customer Preference Regulations, and Meta's WhatsApp Business Messaging Policy.
- Account security. You will keep your DermaAI admin account secure. You are responsible for all messages sent from your workspace.
3. Meta's policies apply
The integration is built on Meta's WhatsApp Business Platform. Meta's WhatsApp Business Messaging Policy and WhatsApp Business Solution Terms apply to you in addition to these terms. In particular:
- No spam, no unsolicited marketing
- No content prohibited by Meta (illegal goods, hate speech, etc.)
- Maintain a quality rating above LOW; sustained low quality may cause Meta to suspend the number
4. Data ownership and processing
You are the data controller for patient communications conducted through the WhatsApp integration. Haiku Studio is the data processor, acting on your instructions. We process patient data only as described in our Privacy Policy.
5. Acceptable use
You will not use the WhatsApp integration to:
- Send messages to non-consenting recipients
- Send content unrelated to your clinic's healthcare service
- Spoof, impersonate, or misrepresent your clinic
- Scrape or extract data from WhatsApp other than as the integration is designed to allow
- Resell the integration or expose it to third parties
6. Service availability
We aim for high availability but do not guarantee uninterrupted service. Outages caused by Meta, network providers, or force majeure are outside our control.
7. Suspension and termination
We may suspend your WhatsApp integration if:
- Meta suspends or restricts your WhatsApp Business number
- You materially breach these terms
- We receive a credible report of unlawful messaging from your workspace
You may stop using the integration at any time by disconnecting your WhatsApp number in DermaAI settings. Data deletion after termination is governed by our Data Deletion Instructions.
8. Liability
The WhatsApp integration is provided "as is". Haiku Studio's aggregate liability for any claim arising from the WhatsApp integration is limited to the fees paid for the integration in the 12 months preceding the claim.
9. Changes
We may update these terms. Material changes will be notified to clinic admins by email at least 30 days before they take effect.
10. Governing law
These terms are governed by the laws of India. Disputes are subject to the courts of [city of jurisdiction — to be confirmed].
